Copyright Policy

KlipSpark respects the intellectual property rights of others and expects users of the Service to do the same. Every user is required to confirm ownership or full rights to any content they upload before processing begins. We take copyright infringement seriously and will act promptly on valid notices.

DMCA Takedown Notice

If you believe that content processed or stored through KlipSpark infringes your copyright, please send a written notification to our designated DMCA agent containing all of the following:

  1. Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material — A description of the material that is claimed to be infringing and information reasonably sufficient to permit KlipSpark to locate the material (e.g., URL or episode ID).
  3. Your contact information — Your address, telephone number, and email address.
  4. Good-faith statement — A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature — A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Please note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

Counter-Notification

If you believe that content you submitted was removed due to a mistake or misidentification, you may send a counter-notification to our DMCA agent. The counter-notification must include: (1) your physical or electronic signature; (2) identification of the removed material and its location before removal; (3) a statement under penalty of perjury that the material was removed by mistake or misidentification; and (4) your name, address, phone number, and consent to the jurisdiction of the federal district court for your address.

Repeat Infringer Policy

KlipSpark will, in appropriate circumstances, disable and terminate the accounts of users who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

Governing Law

These policies are governed by the laws of the United States and the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
