1. Acceptance of Terms

By accessing or using KlipSpark ("Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. User Content Warranties

By uploading any audio file, video link, or other content ("User Content") to KlipSpark, you represent and warrant that:

  • You are the original creator of the User Content, or you have obtained all necessary rights, licenses, consents, and permissions to upload, reproduce, distribute, and create derivative works from the User Content.
  • Your User Content does not infringe any third-party intellectual property rights, including copyrights, trademarks, trade secrets, or moral rights.
  • Your User Content does not violate any applicable law or regulation, including but not limited to privacy laws, defamation laws, or export control regulations.
  • You will not upload User Content that belongs to another person without their express written permission.

You acknowledge that checking the ownership confirmation checkbox at the time of upload constitutes a binding representation that all of the above warranties are true and accurate.

3. License Grant

You retain all ownership rights in your User Content. By uploading User Content, you grant KlipSpark a limited, non-exclusive, royalty-free license to process, store, and display your User Content solely for the purpose of providing the Service to you. We do not sell, share, or use your content for any other purpose.

4. Prohibited Uses

You may not use KlipSpark to:

  • Upload content you do not own or have rights to repurpose.
  • Infringe upon any person's intellectual property rights.
  • Upload content that is unlawful, harmful, defamatory, or obscene.
  • Attempt to reverse-engineer, scrape, or disrupt the Service.
  • Circumvent usage limits or access controls.

5. Subscriptions and Billing

KlipSpark offers a free tier (3 episodes/month) and a Pro subscription at $9.99/month. Subscriptions are billed monthly and renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

6. Enforcement and Termination

We reserve the right to suspend or terminate your account immediately, without notice, if you breach these Terms — including uploading content you do not own. We may also remove any User Content that we determine, in our sole discretion, violates these Terms or applicable law.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ACCURATE RESULTS. AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES AND MAY REQUIRE HUMAN REVIEW BEFORE PUBLICATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLIPSPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
